Copyright & Takedown Policy — BeMusic AI
1. Purpose and Scope
BeMusic AI respects copyright and other intellectual-property rights. This Copyright & Takedown Policy explains:
- What rights you need when uploading, generating, transforming, publishing, or distributing content through BeMusic AI;
- How copyright owners and their authorized representatives can report allegedly infringing material;
- How affected users can respond when material is removed or restricted; and
- How BeMusic AI handles repeat infringement and misuse of the reporting process.
This Policy applies to prompts, lyrics, melodies, compositions, sound recordings, samples, stems, vocals, voice samples, trained voice models, images, videos, metadata, generated output, public tracks, playlists, and other content processed through or made available on BeMusic AI.
This Policy forms part of our Terms of Service and should be read together with our AI & Content Policy, Commercial License Agreement, and Privacy & Cookies.
2. Your Responsibility for Content
You must own or have all licenses, consents, and permissions required for every item you upload, provide, direct BeMusic AI to process, generate from, transform, publish, share, download, or distribute.
Depending on your use, required rights may include rights in:
- Musical compositions, lyrics, melodies, and arrangements;
- Sound recordings, stems, samples, loops, and instrumentals;
- Performances, vocals, voice recordings, and trained voice models;
- Names, images, likenesses, personas, trademarks, and publicity rights;
- Album artwork, video, metadata, titles, and release credits; and
- Covers, remixes, interpolations, mashups, adaptations, and other derivative works.
Purchasing a BeMusic plan, receiving a commercial license, or obtaining a license certificate does not clear third-party material you supplied or directed BeMusic AI to use.
3. Your Uploads and BeMusic Output
You retain any rights you already hold in material you submit. You grant BeMusic AI the limited permissions described in the Terms of Service to host, process, transmit, reproduce, and transform that material as needed to operate the service.
Rights to use eligible BeMusic-generated output are governed by the plan and license applicable to that output. A BeMusic commercial license confirms the platform license for identified eligible output. It is not:
- A copyright registration;
- A transfer or clearance of third-party rights;
- Proof that an upload, sample, voice, or reference was authorized; or
- A guarantee that a distributor, platform, rights-management service, or court will accept a copyright or ownership claim.
Copyright protection for AI-generated material varies by jurisdiction and circumstance. Similar or identical output may be generated for other users, and BeMusic AI does not promise exclusivity.
4. Prohibited Copyright Uses
You may not use BeMusic AI to:
- Upload or distribute copyrighted material without authorization or another valid legal basis;
- Reproduce or closely imitate protected lyrics, melodies, arrangements, or sound recordings without permission;
- Create or distribute unauthorized covers, remixes, interpolations, mashups, or derivative works;
- Upload stems, samples, vocals, instrumentals, or voice recordings you are not authorized to process;
- Falsely claim authorship, ownership, endorsement, collaboration, or affiliation;
- Remove or alter copyright-management information without authority;
- Submit false, misleading, overbroad, or abusive copyright complaints; or
- Register output with Content ID or a similar exclusive-claim system unless you hold the rights necessary to control all resulting claims.
BeMusic AI may refuse a request, restrict access, remove content, disable sharing or downloading, revoke a license certificate where permitted by its terms, or suspend or terminate an account when we reasonably believe there is an infringement or ownership risk.
5. Covers, Remixes, Samples, and Derivative Works
Technical ability to process a file does not mean the resulting use is legally authorized. Depending on what you create and how you use it, you may need permission covering the composition, lyrics, master recording, samples, performers, synchronization, mechanical reproduction, distribution, or other rights.
Private experimentation, transformation, separation, or editing does not automatically make a use lawful. You are responsible for determining which permissions or legal exceptions apply before publishing, monetizing, distributing, publicly performing, or otherwise exploiting the result.
6. Reporting Copyright Infringement
If you own copyright, or are authorized to act for the owner, you may send a copyright notice to support@bemusic.ai with the subject line Copyright Notice — BeMusic AI.
Please include:
- Your physical or electronic signature;
- Identification of the copyrighted work you claim has been infringed, or a representative list if one notice covers multiple works;
- Identification of the material you want removed or restricted, with information reasonably sufficient for us to locate it, such as the exact URL, track title, task ID, song ID, playlist ID, account name, or license-certificate ID;
- Your name, organization if applicable, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act for the owner.
Please do not send unrelated personal data, passwords, payment details, or files that are not reasonably necessary to evaluate the claim. We may request additional information if a notice is incomplete or the material cannot be located.
7. What BeMusic AI May Do After Receiving a Notice
After receiving a sufficiently complete notice, BeMusic AI may:
- Remove or restrict access to the identified material;
- Disable public sharing, playback, downloading, licensing, or other features associated with it;
- Notify the affected user and provide relevant portions of the notice;
- Ask either party for additional information;
- Preserve records reasonably needed for the dispute, fraud prevention, safety, or legal compliance; and
- Suspend or terminate accounts in appropriate circumstances.
Removal or restriction is not a final determination that infringement occurred. We may decline to act on notices that do not identify the material, lack required information, are facially invalid, or appear fraudulent or abusive.
8. Counter-Notices
If your content was removed or restricted because of a copyright notice and you believe the action resulted from mistake or misidentification, you may send a counter-notice to support@bemusic.ai with the subject line Copyright Counter-Notice — BeMusic AI.
For a counter-notice under the U.S. Digital Millennium Copyright Act, include:
- Your physical or electronic signature;
- Identification of the material removed or restricted and the location where it appeared before removal or restriction;
- A statement under penalty of perjury that you have a good-faith belief the material was removed or restricted because of mistake or misidentification;
- Your name, mailing address, telephone number, and email address; and
- A statement that you consent to the jurisdiction of the United States federal district court for the judicial district where your address is located, or, if your address is outside the United States, any judicial district where BeMusic AI may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent.
We may forward a valid counter-notice, including the contact information it contains, to the original claimant. Where the DMCA applies, BeMusic AI may restore the affected material no sooner than 10 and no later than 14 business days after forwarding a valid counter-notice unless the claimant notifies us that it has filed a court action seeking to restrain the allegedly infringing activity. We may keep material restricted where another legal, safety, privacy, or policy basis independently requires restriction.
9. Repeat Infringers
BeMusic AI may suspend or terminate users who repeatedly infringe copyright or repeatedly submit content presenting unresolved rights risks. We apply this policy in appropriate circumstances and may consider valid notices, counter-notices, retractions, court decisions, account history, and evidence of deliberate or systematic abuse.
We may also restrict particular features, including public sharing, downloads, voice-model training, license-certificate issuance, or access to uploaded source material.
10. Retractions and Resolved Disputes
A claimant may retract a notice by emailing support@bemusic.ai from the same address used for the original notice and clearly identifying the material and notice being withdrawn. The parties may also provide a court order, settlement confirmation, or other reliable evidence that a dispute has been resolved.
Retraction does not require BeMusic AI to restore material that independently violates another policy or law.
11. Misrepresentations and Abuse
Knowingly making material misrepresentations in a notice or counter-notice may create legal liability. Fraudulent, automated, harassing, or abusive reporting may result in rejection of the request, account restrictions, or other appropriate action.
BeMusic AI may share notices and counter-notices with the affected parties, professional advisers, service providers, or authorities when reasonably necessary to process the request, protect rights, or comply with law. Our handling of personal data is described in the Privacy & Cookies.
12. International Copyright Complaints
The notice-and-takedown requirements above are designed to collect the information normally needed to evaluate copyright complaints, including notices under the U.S. DMCA. Rights holders outside the United States may use the same contact and should identify the applicable right, territory, legal basis, location of the material, and supporting evidence.
We may adapt the procedure where local law requires different information, timing, forwarding, removal, or restoration steps.
